Let me tell you a story about the engine that failed.  All the big name fancy-dance mechanics were brought in but not one could fix it. Then they brought in the guy with nearly 30 years on the job. He inspected the engine carefully, top to bottom. After looking things over, the guy reached into his bag and pulled out a small hammer. He gently tapped something on the engine. Instantly, the engine lurched into life. The engine was fixed! Seven days later the owners got his bill for $10,000.00.  “What?!” the owners said, “You hardly did anything! Send us an itemized bill.” The man immediately sent the following itemized bill: “Tapping with a hammer: $2.00.   Knowing where to tap: $9,998.00” Moral of the story:  Don’t ever underestimate the power of experience if you want something to work right.

Deciding whether you should retain a particular attorney is difficult.  Simple observation tells anyone that the attorney with significant trial experience is not easily distinguishable from the case-settling colleagues. Most attorneys wear suits and go to court.  Some attorneys get awards.  But awards by themselves mean nothing.  How do you see the difference between the experienced professional lawyer and the dozen lawyers named “Better Lawyer,” or “Best in the Country” or “Top Lawyers” that are completely subjective in nature or may even be worse as simply a pay-to-award list that some lawyers join.  I would suggest that rather than looking if a lawyer is a member of a “who’s who” list of some sort, find the lawyer “who’s done it.”  Doing that will lead you to Paul Ksicinski.

Paul Ksicinski is an attorney with almost 30 years’ experience.  Experience has taught him how to defend cases in ways no one else did: Paul Ksicinski filed the first challenge to race based traffic stops (racial profiling) in Milwaukee County; the first challenge to Milwaukee County In-Custody Intake procedure of shackling all criminal defendants; he exposed racial origins of felon disenfranchisement by filing the first Wisconsin Voter’s Right Act challenge to felon disenfranchisement.  He also challenged Wisconsin’s same sex marriage ban.  Paul Ksicinski’s trial practice has been highlighted by the televising of one of his homicide trials on TRU TV. When he was able to get a dismissal of a first degree homicide and sexual assault charges on a mentally retarded man, the prosecutor who charged the case even apologized to the client in court.

Paul Ksicinski’s awards are based on experience not on paying someone.  For instance, while a public defender, he received the First Assistant Award for most misdemeanor dismissals at trial.  Based on what he did, Paul Ksicinski was the recipient of the Wisconsin Public Defender Performance Recognition Award that honored his “sustained outstanding performance” regarding client representation.  He was also awarded Certificate of Appreciation from Public Defender Office for “perseverance, leadership and attention to detail” so that the Office was “better prepared to argue issues in the area of identity, expert witnesses and motions in limine.”
